The Vermont Supreme Court is a disgrace to human freedom and dignity. This decision limits families to the federal PREP Act for recoveries, and thus only for "death or serious bodily injury." Meaning, there are separate chains of liabilities. Even if Pfizer is immunized from the legal repercussions of their immunizations, they are still morally, ethically and practically responsible if their products cause harm. If there is no harm from their products their chain of liability is complete. However, a school could use a product that causes no harm (as appears to be the case with the Politellas), but could still be liable for violating informed consent. Anyone who uses syringes is (or should be) legally liable for the informed consent of the injected. Period. It doesn’t matter if it is saline, meth or a vaccine, if you are sticking someone with something they have the right to say no and be informed on its contents. This is completely separate from the liability of the product within the syringe.
